When you make a Booking through our Site or Services, you are offering to purchase travel services from us. All Bookings are subject to availability and confirmation by us. We reserve the right to decline any Booking at our sole discretion.
By making a Booking, you confirm that you have read, understood, and accepted these Terms, as well as any terms and conditions specific to the travel services being booked.
You are responsible for ensuring that all information provided for the Booking, including but not limited to personal details, travel dates, and preferences, is accurate and complete. We are not liable for any issues, losses, or additional costs arising from incorrect or incomplete information provided by you.
It is your responsibility to ensure that all travelers' names match exactly with their passport or other valid travel identification document. Failure to provide accurate information may result in denied boarding, cancellation of bookings, or additional fees.
A contract between you and SoftMarina is formed when we issue a Booking Confirmation. If you do not receive a Booking Confirmation within 48 hours of making a Booking, please contact us.
Upon receiving your Booking Confirmation, you must check the details carefully and notify us immediately of any inaccuracies. We reserve the right to correct any errors in prices or descriptions of travel services at any time before or after your Booking is confirmed.
Payment terms vary depending on the type of travel services booked and the Service Providers involved. The specific payment terms applicable to your Booking will be communicated to you during the booking process.
Generally, the following payment terms apply:
If full payment is not received by the due date, we reserve the right to cancel the Booking and retain the deposit.
We accept various payment methods, including major credit and debit cards, bank transfers, and other specified payment methods. All payments must be made in the currency specified in the Booking Confirmation.
For credit or debit card payments, you authorize us to charge the relevant payment to the card provided. You confirm that you are the cardholder or have the cardholder's permission to use the card.
All prices displayed on our Site are subject to change at any time before your Booking is confirmed. After your Booking is confirmed, prices may still change due to variations in exchange rates, taxes, or Service Provider fees.
Unless otherwise stated, prices include applicable taxes and fees. However, some local taxes, resort fees, or service charges may be payable directly to the Service Provider at the destination.
We make every effort to ensure the accuracy of prices displayed on our Site, but errors may occasionally occur. We reserve the right to correct any pricing errors and to cancel Bookings made at an incorrect price.
SoftMarina acts as an intermediary between you and the Service Providers. We are not a provider of travel services ourselves. The travel services you book through us are provided by independent Service Providers.
Each Service Provider has its own terms and conditions that apply to the services they provide. By making a Booking, you agree to be bound by the terms and conditions of the relevant Service Providers. We will provide you with access to these terms and conditions upon request.
We will issue or forward Travel Documents to you once your Booking is confirmed and full payment has been received. It is your responsibility to check all Travel Documents carefully upon receipt and contact us immediately if you believe any information is incorrect.
You must present the required Travel Documents at the time of travel. We are not responsible if you are denied travel or entry to a destination due to missing or invalid Travel Documents.
We strongly recommend that you purchase comprehensive travel insurance to cover potential risks associated with travel, including but not limited to trip cancellation, medical emergencies, loss of personal belongings, and travel delays. It is your responsibility to ensure that any insurance policy you purchase is adequate for your needs.
We can provide information about travel insurance options upon request, but we do not provide insurance services directly.
It is your responsibility to consult relevant government travel advisories and health authorities for information about the safety and health requirements of your destination. We recommend checking this information regularly before and during your travels.
We are not responsible for any travel disruption, loss, or inconvenience resulting from your failure to comply with travel advisories or health requirements.
It is your responsibility to ensure that you and all members of your party have valid passports, visas, and meet all immigration requirements for the countries you will visit. Passport and visa requirements can change, and you should check the up-to-date requirements with the relevant embassies or consulates before traveling.
We are not liable for any costs, losses, or damages resulting from your failure to comply with passport, visa, or immigration requirements.
We will endeavor to communicate any special requests (such as dietary requirements, accessibility needs, or room preferences) to the relevant Service Providers but cannot guarantee that these requests will be met. Failure to meet special requests does not constitute a breach of contract by us.
If you wish to make changes to your Booking after it has been confirmed, you must contact us as soon as possible. We will endeavor to accommodate your request, but changes cannot be guaranteed and may be subject to availability and additional charges.
Any change request must be made in writing and is only effective once we have confirmed acceptance of the change. You will be responsible for any price differences or amendment fees charged by Service Providers as a result of the change.
If you need to cancel your Booking, you must notify us in writing as soon as possible. Cancellation charges will apply based on when we receive your written cancellation notice and the terms and conditions of the Service Providers involved.

Some travel services, such as promotional fares, may be non-refundable from the time of booking. The specific cancellation policy applicable to your Booking will be communicated to you during the booking process.
We and the Service Providers reserve the right to make changes to or cancel confirmed Bookings in certain circumstances. If a significant change or cancellation is made before departure, except due to a Force Majeure Event or your fault, you will be offered the choice of:
A significant change includes a change of departure time by more than 12 hours, a change of departure or destination airport (except between airports serving the same city), a change of accommodation to a lower standard, or a change of the overall length of your holiday by more than 24 hours.
Minor changes do not entitle you to cancel or change your Booking without paying our normal charges. Minor changes include a change of accommodation to another of the same or higher standard or a change of departure time by less than 12 hours.
We will not be liable for any failure to perform or delay in performing our obligations under these Terms due to a Force Majeure Event. If a Force Majeure Event affects your Booking, we will notify you as soon as reasonably possible and discuss available options.
If a Force Majeure Event continues for more than 30 days, either party may cancel the affected Booking by giving written notice to the other. In such cases, we will use reasonable efforts to assist you in obtaining a refund from Service Providers, but we cannot guarantee full refunds.
We will use reasonable skill and care in performing our obligations under these Terms. However, as we act as an intermediary between you and the Service Providers, we are not responsible for the actual provision of travel services.
To the maximum extent permitted by law, our liability for any claim arising from or related to your Booking or these Terms is limited to the amount paid by you to us for the Booking. We are not liable for any indirect, special, incidental, or consequential damages.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded by law.
Service Providers are responsible for the travel services they provide in accordance with their own terms and conditions. If you have any complaints or claims regarding the travel services provided, you should direct them to the relevant Service Provider in the first instance.
We will provide reasonable assistance to help you resolve any issues with Service Providers, but we are not responsible for their acts or omissions.
You agree to indemnify, defend, and hold harmless SoftMarina, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with:
If you experience any issues during your travel, you should report them immediately to the relevant Service Provider and to us. This gives us the opportunity to resolve issues while you are still traveling. Failure to report issues promptly may affect your rights to compensation.

If you wish to make a complaint after your travel has ended, you must submit it in writing to [email protected] within 28 days of the end of your travel. Your complaint should include your booking reference number, details of the issues experienced, and any supporting documentation.
We will acknowledge receipt of your complaint within 7 days and provide a full response within 28 days. If we need more time to investigate your complaint, we will keep you informed of our progress.
If we are unable to resolve your complaint to your satisfaction, you may be entitled to refer the matter to an alternative dispute resolution (ADR) entity. We will provide details of the relevant ADR entity upon request.
These Terms are governed by the laws of England and Wales. Any dispute arising from or related to these Terms will be subject to the exclusive jurisdiction of the courts of England and Wales.
We collect and process personal data in accordance with our Privacy Policy, which is available at Privacy Policy. By using our Site or Services, you consent to our collection and processing of your personal data as described in the Privacy Policy.
To provide our Services, we need to share your personal data with Service Providers and other third parties involved in fulfilling your travel arrangements. By making a Booking, you consent to this sharing of your personal data.
These Terms, together with the Booking Confirmation and any other documents expressly incorporated by reference, constitute the entire agreement between you and us regarding your use of the Site and Services, and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and us.
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect. The invalid or unenforceable provision will be deemed modified so that it is valid, legal, and enforceable to the maximum extent permitted by law.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. The waiver of any such right or provision will be effective only if in writing and signed by an authorized representative of SoftMarina.
You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. We may assign or transfer these Terms, at our sole discretion, without restriction.

A person who is not a party to these Terms has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of these Terms.
We reserve the right to modify these Terms at any time. If we make changes to these Terms, we will post the revised Terms on the Site and update the "Last Updated" date at the top of these Terms. Your continued use of the Site or Services after the posting of the revised Terms constitutes your acceptance of the changes.
These Terms will apply to your Booking at the time you make the Booking, even if these Terms are subsequently changed.
